Mercer County Medical Society FAQ’s

1. How long does a physician have to maintain records?
Adults - Seven years from that last date of a patient visit.
Minors - Until the legal age plus two years (basically 21 yrs. of age). Physicians should educate parents to keep their children’s records safe. Often people call seeking records for serious health issues long after the age limit. This information can be crucial in a life threatening matter.

2. Who owns the patient records?
Records are the work product of the physician. Patients are entitled to a copy of the record. A patient must provide a written release and pick up the records within 30 days.

3. Can a physician charge a patient for copying records?
Yes, the New Jersey Board of Examiners statute states that a minimum of $10 can be charged with a maximum of $100. If the record is three pages $10 can be charged. If the record is 200 pages no more than $100 can be charged.

4. Can records be withheld if a patient has an outstanding bill?
Not if the records are needed for on going care.

5. When an insurance company denies treatment what can patients do?
The New Jersey Department of Banking and Insurance, Division of Consumer Protection, has a simple form for people to list their complaint. All complaints are reviewed and if the company is self-insured the US Department of Labor then steps in.

6. When a patient questions their medical bills?
The Mercer County Medical Society’ has a Judicial Committee that reviews disputes for members. Often with a phone call issues are resolved. If the physician is not a member complaints are referred to the New Jersey Board of Medical Examiners.

7. What do I do if I have lost, stolen, or forged subscription blanks?
Physician has 72 hours to report lost, stolen, or forged subscription blanks to the New Jersey Office of Drug Control – NJPB Unit. Follow the two steps below.

1. Telephone the New Jersey Prescription Blank Unit immediately. Their number is (973) 504-6558.
2. File a NJPB Incident Report [click here to download a copy of the report form] within 72 hours by filling out the form and mailing it certified mail, return receipt requested to:
